  • $1 Million Wrongful Death

In this case, attorney Brendan Mullarkey represented the estate of a person who died in an automobile accident. Our client was thrown from a work truck and was then run over by a tractor-trailer and died on I-81. The insurance company denied our claim because they claimed the tractor-trailer driver was not negligent and there was no proof that our client was killed by the tractor-trailer. After an exhaustive search, our firm discovered a witness who could confirm that the work truck flipped over on a clear stretch of road and that the tractor-trailer would have had ample time to stop and should have stopped because of all of the debris in the road. The firm also hired a medical examiner to review the autopsy report and all of the pictures from the scene to determine that the injuries and the blood splatter at the scene were not consistent with the cause of death, and therefore the cause of death was most likely the tractor-trailer. At mediation, $1,000,000,00 was offered by the insurance company and accepted by the estate.

  • $850 Thousand Motor Vehicle Accident

In this case, attorney Brendan Mullarkey represented a person who injured his elbow in an automobile accident. The accident occurred on I-95. The Defendant alleged her tire blew out on the highway and hit our client's car. The accident caused our client's car to flip over and slide down the highway 300 yards upside down. After the accident, our client had elbow surgery, but continued to have restrictions and pain even after surgery. The firm focused on the effect that the client's injuries had on his relationship with his grandchildren and a 45% impairment rating that the client's expert alleged was caused by this accident. The case was resolved -- without the need for mediation -- in the amount of $850,000.00.

  • $500 Thousand Front Bumper Accident
In this case, attorney Brendan Mullarkey represented a client who was injured when she was stopped at a traffic light and the driver in front of her reversed into her car. Our client experienced ongoing lower back pain before the accident, but she did not have neck pain before the accident. Following the accident, she had ongoing neck pain. Our client sought treatment, to include physical therapy and injections, but her pain continued and a doctor opined that her pain was likely permanent. We filed a lawsuit and, after a bench trial, a judge awarded $500,000.00 to our client for her injury.

After the Mediation Conference which spanned multiple days, the case was ultimately resolved for a settlement in the amount of $500,000.00.
  • $300 Thousand Motor Vehicle Accident
In this case, Attorney John Robert Kelly represented a woman who was a passenger in an Uber that was rear-ended by another driver. The at-fault driver refused to accept responsibility until deep into the litigation process. Because the at-fault driver had insufficient insurance limits to compensate my client for her injuries, our client’s own insurance company was involved, and we also pursued an Underinsured Motorist claim. The parties ultimately agreed to engage in binding arbitration. After listening to our client’s testimony, and reviewing the medical evidence, the arbitrator awarded our client $300,000.00, for her injuries.
