Protecting Your Right to Virginia Workers’ Compensation Benefits
Virginia workers generally should report a work-related crane injury to their employer immediately and no later than 30 days after the accident in most cases. Giving notice to an employer isn’t the same as filing a claim with the Virginia Workers’ Compensation Commission. To protect the right to benefits, an injured worker generally must file a Claim Form with the Commission within two years of the accident, subject to statutory exceptions.
Medical documentation and wage records can become central to the claim. The evidence may need to establish the diagnosis, authorized treatment, work restrictions, missed time, pre-injury earnings, and whether the worker can perform an offered light-duty position.
Depending on the injury and claim status, workers’ compensation benefits may include:

- Temporary disability benefits: Wage-loss compensation that may apply when the worker can’t work or earns less during recovery.
